Justice Challenges Claims Rep in Asbestos-Related Bankruptcy

The U.S. Trustee has filed an unusual challenge to the appointment of a Future Claims Representative in a bankruptcy case involving claims for asbestos-related injuries or illnesses.

It’s only the second time the U.S. Trustee Program, a component of the Justice Department, has objected to the appointment of an individual to serve as FCR. It filed a similar objection in another case Sept. 26.

The Fairbanks Company filed for Chapter 11 reorganization in Rome, Ga., July 31, to resolve existing and future asbestos injury and death claims from exposure to the company’s products more than 40 years ago, it said ...
