UnitedHealth, DaVita Slam No-Poach Suit for Antitrust Overreach

UnitedHealth Group Inc. and DaVita Inc. moved to end civil litigation over an alleged employee “no poach” agreement between their affiliates, telling a federal judge in Chicago the ex-employees leading the case overreached by portraying the pact as a “per se” antitrust violation.

United and DaVita filed a joint motion Monday seeking to dismiss the proposed class action from the U.S. District Court for the Northern District of Illinois, where Judge Andrea R. Wood is presiding over consolidated litigation that also includes a first-of-its-kind criminal prosecution by the Justice Department.
